Commission Terms of Service/Client Agreement form

Please review the terms of service outlined below. By commissioning me, you confirm that you have both read and agreed to these terms:

1. General Overview

• I, the artist, retain full image copyright to the produced work

• I, the artist, reserve the right to refuse a commission request

• Payment must be in USD and must be conducted through PayPal or Venmo

• Workflow will vary depending on complexity of the artwork

• Refunds will not be given once the client has approved of the initial sketch/design

• The client has selected the type of artwork they would like based on the current available commission types

2. Usage and Copyright

• I, the artist, doing business as and using the pseudonyms ‘Bee’, ‘Bee Carmine’, and/or ‘The Midnight Menagerie’, respectfully, hereto referred to as ‘the artist’, retain the image rights to the completed artwork:

• Commissions depicting any form of copyrighted material is exempt from the above statement, such as in the case of 'fan art'

• I, th artist, reserve the right to post the completed image on my social media, unless otherwise requested by the client 

• I, the artist, reserve the right to use the completed artwork as an example piece for future commissions

• I, the artist, reserve the right to include the completed artwork in current and future portfolios

• The client retains the rights to characters and concepts of their own creation

• The client may not use any aspect of the commission for commercial purposes

• The client may not claim ownership of any aspect of the commission 

• The client may not alter, repurpose, or reference any aspect of the commission

• The client may post the completed artwork to their social media, so long as my information is given in said post

• The client may make copies of the completed artwork for personal and non commercial use only 

• The client acknowledges that I, the artist, will sign the completed commission and that removal/willful tampering of said signature is considered copyright infringement (inclusion of signature depends on type of artwork)

3. Payment and Refund Policy

• Payment must be given in USD

• Payment will be conducted through PayPal or Venmo exclusively

• 50% of the full cost of the commission must be given before or after the initial sketch/design has been produced

• The remaining 50% must be paid upon receipt of the finished commission 

• Prices are non-negotiable

• The client may not send payment before it has been requested

• Refunds will not be given after work has begun and the upfront cost of 50% has been issued

• Refunds are negotiable on a case-by-case basis

4. Workflow and Revisions 

• The timeframe for completion of a single commission will vary

• A general timeframe will be given after the client and the artist have agreed upon the details of the commission

• Artwork will be completed within the expected timeframe to the best of the artist's ability

• If delays occur, the client will be notified ASAP

• After the client and the artist have agreed upon the details of the commission, the client will receive a sketch/loose design and be prompted for approval:

• If the client approves of the initial sketch, work on the completed artwork will begin

• If the client does not approve of the initial sketch, edits may be requested until the client is satisfied

• Edits may not be requested once the initial sketch has been approved

• Edits requested to aspects of the artwork that were previously approved will incur additional fees

• The client may request to receive frequent updates on their commission, however this will not be given unless requested

• Updates or work in progress images shared with the client will be watermarked

• Sketches and updates may not be shared on the clients social media

5. Delivery

• For digital mediums:

  • Completed commissions will be sent via client email

  • Unless otherwise requested, digital files will be sent as a PDF

  • The client may request multiple copies of the completed artwork under different file names (i.e. PNG, JPEG, etc.)

  • The full list of terms provided will also apply to commissions made using digital mediums
